This is our first newsletter of this year. We have started the semester with new projects and we would like to share with you a brief summary of our activities. The Newsletter 01/2019 of the Center for Conflict Resolution of the University of Lucerne (CCR) addresses both an international and a German-speaking audience. It is a quaterly newsletter to keep you informed on topics such as our continued education activities, our academic projects, latest publications, seminars and conferences.

Workshop-Tagung zum Zivilprozessrecht: Entwicklungen und Stolpersteine

Der Zivilprozess befindet sich im Wandel. Nach rund acht Jahren steht die erste grössere Revision der schweizerischen Zivilprozessordnung an. Diese Tagung greift neue und alte Herausforderungen rund um den Zivilprozess auf. Ausgewiesene Spezialistinnen und Spezialisten leiten jeweils 70-minütige Workshops zu den Themen Vergleich, IT im Zivilprozess, Prozessfinanzierung sowie zur Revision der ZPO.

Swiss Arbitration Day

On Saturday, February 16, all Swiss universities participating in the 26th Willem C. Vis International Commercial Arbitration Moot Court met at the University of Lucerne for the Swiss Day 2019 sponsored by Homburger AG. The Swiss Day is an integral part in every team's preparation for the oral phase of the Willem C. Vis Moot and a meeting point for the "Swiss Moot Society" as a whole. In various rounds, the teams had the opportunity to present their pleadings to renowned arbitration panels consisting of former mooties, coaches, practitioners and professors. The detailed feedback from the arbitrators will certainly help every team on their way to Vienna, the final stage of the Willem C. Vis Moot (13 – 16 April 2019). 

Aussergerichtliche Konfliktlösung (PrintPlu§)

Endlich liegt ein Buch zur aussergerichtlichen Konfliktlösung (ADR) vor, welches die massgeblichen Erkenntnisse verschiedener, unerlässlicher Disziplinen vereint darstellt. Das Werk beleuchtet Recht, Kommunikation, Psychologie, Soziologie und Wirtschaft. Prof. Dr. Daniel Girsberger und Dr. James Peter haben daher mit der vorliegenden Veröffentlichung eine wichtige Lücke geschlossen. Dabei werden nicht nur die verschiedenen ADR-Verfahren und ihre rechtlichen Grundlagen in der Schweiz, sondern auch die Europäischen und internationalen Regelwerke dargestellt. 

Das Buch ist benutzerfreundlich gestaltet und vermittelt die Inhalte durch verschiedene Grafiken auch visuell. Im Anhang finden sich zudem die wichtigsten Gesetzestexte zu den verschiedenen ADR-Verfahren, mit denen zur Zeit in der Schweiz und im internationalen Umfeld gearbeitet wird. Dieses Buch sollte als Standardwerk in jede Anwaltskanzlei Einzug finden. Präjudizienbuch Zivilprozessordnung (ZPO)

Zur ZPO sind viele Bücher erschienen. Die Rechtsprechung des Bundesgerichts hat inzwischen selbst die Dichte eines Kommentars und grössere Praxisrelevanz. In der Fülle der Urteile geht die Essenz leicht verloren. Das Präjudizienbuch ZPO erschliesst die gesamte bundesgerichtliche Rechtsprechung durch kurze, nach Artikeln strukturierte und ins Deutsche übersetzte Auszüge aus allen relevanten Entscheiden. Berücksichtigt sind die seit Inkrafttreten der ZPO ergangenen Entscheide und die ältere Rechtsprechung, soweit sie weiterhin von Bedeutung ist. Das Präjudizienbuch ermöglicht Rechtsanwältinnen und Rechtsanwälten, Gerichtspersonen sowie Anwaltskandidatinnen und -kandidaten leichten und direkten Zugriff auf das jeweils einschlägige Urteil des Bundesgerichts. Der Anhang enthält die wichtigsten kantonalen Einführungsgesetze.
